Terms & Conditions of Hire

By acceptance of equipment the hirer agrees to be bound by the Company's terms and conditions to the total exclusion of all other terms either express or implied by the Company, its servants or agents. These terms may only be varied if agreed in writing by the Company and signed by a director of the Company. Under the terms of the agreement "Company" shall mean Total Audio Solutions Ltd. & the word hirer shall mean customer.

1. The Hirer agrees to abide by the Conditions of Use as set out on the reverse of the hire license or free permit and to indemnify the Company against any penalty or seizure of equipment imposed upon the Company by virtue of breach by the Hirer of the Conditions of Use. The Hirer should also be aware of the potential penalties he/she can incur under the "Wireless Telegraphy Acts" for 'improper or unauthorised use of the equipment and insuring its proper use under the terms of the license.

2. The Hirer shall be responsible for complying with all statutory requirements, obligations or regulations relating lo the use or testing of the installation as may be laid down by the Competent Authorities. The Company undertakes to modify the installation to comply with the foregoing requirements when necessary at the Hirers expense to ensure the equipment complies with the relevant technical specifications and conditions of use.

3. The Hirer agrees to return and collect the equipment at his/her own expense from the premises of the Company,

4. Should the equipment be returned incomplete or late, then the Company reserves the right to charge a pro-rata rate of hire relating to the duration of the overdue hire, and/or until the entire equipment be returned.

5. It is agreed that the installation shall remain the property of the Company, and the Hirer agrees to indemnify the Company for any loss or damage of, to, or by the installation, however caused, including loss or damage caused by negligent or willful acts of the Company, its servants or agents. the Company shall not be responsible for any consequential loss or damage which the Hirer may incur by reason of the installation and accessories not being at anytime in full working order.

6. The Hirer acknowledges that he/she shall not be entitled to any refund or deductions of hire charges.

7. The Company agrees during the continuance of this hire to execute by its servants, agents, or contractors, during normal working hours, Monday to Friday (excluding Bank Holidays) without charge for labour and materials all repairs and replacements to the installation, necessitated by fair wear and tear. The duly authorised representative of the Company shall at all times have access to the premises/location of the Hirer to inspect and repair the installation during the continuance of the hire and to remove it if the Hirer is in breach of these terms, The Hirer agrees to notify the Company in writing immediately any fault occurs on the installation or any repairs are necessary for the satisfactory working of the system. Faulty equipment must be forwarded at the Hirers cost to the Company's offices for attention. The supply of electricity, the replacement of batteries, the antennas and all connecting cables are not included in the Company's maintenance service. The Company shall not be liable for faults caused by fluctuating mains voltage, outside electromagnetic interference, exceptional environmental conditions, misuse of the system, reverse polarity, or faults found on the equipment supplied or caused by a third party. Any faults will be dealt with as quickly as possible during the hire period.

8) All payments shown in, or becoming payable under this contract are exclusive of VAT @ 17.5%

9) The Hirer agrees to hire the equipment set out in the supplied confirmation at the rates set out in the said Confirmation and to pay the hire charges without deduction within 1 4 days of the date of this signed contract.
